Georgia’s Fault-Based System
About a dozen states in the United States follow what is known as a no-fault system for car accidents. This means that the driver’s insurance covers certain losses, regardless of who caused the crash.
However, Georgia car accident laws follow a different system, called the traditional “fault-based” system. This means that the person who is found at fault is financially responsible for injuries, vehicle damage, and other effects.
In practical terms, the at-fault driver’s insurance company covers other people’s losses that result from the accident up to the driver’s liability coverage.
